- Online sales policy
The information used to describe the Goods and/or Services available on the Site (text, static or dynamic images, video, etc.) does not represent a contractual obligation on the part of the Seller and is used for presentation purposes only. Casa Kendra makes constant efforts to provide accurate and correct information on the pages of the Goods and/or Services available on the Site, but there may be situations where they contain inaccuracies: technical errors or human operating mistakes, informative photographs that may show specifications or accessories not included in standard configurations, specifications changed by manufacturers without notice, etc.
Communication with the Seller may take place through direct interaction with the Seller, including through online support (chat), or by means of the telephone number or email address indicated in the contact section of the Site. The Seller is free to handle the information received from the User, Account Holder or Buyer, regardless of the channel through which it was received, as the Seller deems necessary and without having to justify itself in any way.
Romanian is the language of communication between the Seller and the User, Account Holder or Buyer, as well as the language in which the Content and any documents, procedures, transactions etc. governed by these terms and conditions are drafted.
All prices of the Goods and/or Services presented on the Site are expressed in RON and include value added tax (VAT). Payment for the Goods and/or Services purchased by the Buyer will be made in lei (RON),
For card payments, the Seller is not, and cannot be held, responsible for any other additional costs incurred by the Buyer, including but not limited to currency conversion fees charged by the card-issuing bank, where the card's currency of issue differs from the leu (RON). Responsibility for such costs lies exclusively with the Buyer.
- Contractual documents
By placing an Order on the Site, the Buyer agrees to the form of communication through which the Seller conducts its commercial operations (phone, email, chat).
The transactional message received by the Buyer immediately after placing the Order is for information purposes and does not constitute acceptance of the Order.
For well-founded reasons, the Seller reserves the right to make changes to the quantity or number of Goods and/or Services in an Order placed by the Buyer. The Seller will notify the Buyer of this change at the email address or phone number provided to the Seller when placing the Order and will refund the Buyer any additional amounts paid.
The Contract is deemed concluded between the Seller and the Buyer at the moment the Buyer receives from the Seller, by email and/or SMS, the transactional Order confirmation message.
These terms and conditions, together with the information made available by the Seller on the Site and the transactional messages sent to the Buyer after an Order is placed, form the basis of the Contract concluded between the Seller and the Buyer.
- Assignment and subcontracting
The Seller may assign and/or subcontract to a third party, in whole or in part, Services related to the fulfilment of Orders, with notice to the Buyer but without the Buyer's consent being required. The Seller will always remain responsible to the Buyer for all contractual obligations incumbent upon it.
- Order
Placement
The User, Account Holder or Buyer may place Orders on the Site by adding the desired Goods and/or Services to the shopping cart, then completing the Order by selecting the delivery method and then the payment method. Merely adding a Good and/or Service to the shopping cart, without completing the Order, does not result in an order being registered.
By completing the Order, the Buyer agrees that all the information provided to the Seller, necessary for the purchase process, is correct, complete and true on the date the Order is placed. The Buyer also understands and agrees that the Seller may contact them, by any means of communication agreed by the Seller, in any situation where such contact is necessary.
Cancel
The Seller may cancel the Order placed by the Buyer, without any further obligation of either party towards the other and without either party being able to claim damages from the other, in the following cases:
- non-acceptance of the Transaction by the Buyer's card-issuing bank;
- invalidation of the Transaction by the payment processor approved by the Seller;
- incomplete and/or incorrect information provided by the Buyer on the Site;
- the Buyer's failure to pay within 48 (forty-eight) hours of placing the Order, where bank transfer (wire transfer, mobile or internet banking) was selected as the payment method;
- the Sale Price of the Good and/or Service purchased by the Buyer is a derisory price, as defined in art. 1665 of the Civil Code (Law no. 287/2009);
- the delivery of the Goods and/or the provision of the Services proved impossible, despite the Seller's repeated efforts.
Change
If the Seller cannot fulfil, in whole or in part, a Buyer's Order because the ordered Goods and/or Services cannot be delivered and/or provided, the Seller will inform the Buyer without delay. The Buyer may decide to amend the Order (the Seller supplying only some of the Goods and/or Services in the initial Order, or replacing one or more Goods and/or Services with similar ones) or to terminate the Contract. The Seller will refund the Buyer all amounts resulting from the amendment of the Order or termination of the Contract within no more than 7
(seven) days from the date on which the Buyer expressly and unequivocally communicated their decision.
Right of withdrawal
The Buyer (in this context this term meaning only a natural person) has the right to withdraw from the Contract, namely to return a Good or to give up having a Service provided, within 14 calendar days, without giving any reason and without bearing any costs other than the return costs. In accordance with the provisions of OUG no. 34/2014, the period for returning a Good or giving up a Service expires within 14 days from:
- the day on which the Buyer takes physical possession of the last of the ordered Goods, where the Order placed by the Buyer included several Goods that were delivered separately by the Seller;
- the day on which the Buyer takes physical possession of the last of the Goods or the last piece, where a Good consisting of several lots or pieces is delivered.
The following are excluded from the right of withdrawal from the Contract:
- Goods made, produced or customised to the Buyer's specifications, such as lengths of textile materials, curtains, wallpaper, items configured and produced to the Buyer's requirements (walk-in closets, sofas, armchairs, etc.), or modified at the Buyer's request during assembly;
- Goods that cannot be returned for health protection and hygiene reasons: pillows, duvets, mattresses, bed linen;
- The provision of Services, after their complete performance, if performance began with the Buyer's prior express consent and after the Buyer confirmed that they acknowledge that they will lose their right of withdrawal.
If the Buyer requests withdrawal from the Contract within the legal period of 14 days, the Buyer must return, together with the returned Goods, any gifts, freebies, etc. that were offered by the Seller along with them at the time of purchase.
The Goods must be returned by the Buyer packed in sturdy packaging or in the original packaging (if it still exists), to prevent damage during transport. The costs of returning the Goods are borne by the Buyer. If the Seller has offered to collect the Goods from the Buyer itself, the return cost will be equal to the delivery cost originally paid by the Buyer, in which case the value of the delivery cost will not be refunded to the Buyer. If assembly and/or transport on delivery were free of charge, the delivery costs are borne by the Buyer when the products are returned.
If the Buyer exercises the right of withdrawal within the time limit, the Seller will refund, within no more than 14 (fourteen) days from the date of receiving the Buyer's notification of the decision to withdraw from the Contract, the amounts received as payment for the Goods and/or Services purchased (except for the value of assembly services and, where applicable, the value of the shipping service, as mentioned above). The amounts will be returned as follows:
- for Orders paid by card: by refund to the account associated with the card used for payment;
- for Orders paid by bank transfer: by bank transfer to the account provided by the Buyer.
The Seller may postpone the refund until the Goods returned by the Buyer have been received or until the Buyer provides proof that they have been shipped, unless the Seller has offered to collect the Goods itself (whichever is earlier will be taken into account).
If the Goods returned by the Buyer are in a condition in which they can no longer be sold as new (missing components or accessories, visible aesthetic or functional damage, etc.), the Seller reserves the right to reduce the amount refunded to the Buyer in order to restore the Goods to their original condition or, as the case may be, to cover the price difference resulting from the resale of those Goods as used products.
Availability
When placing an Order, the availability of the Goods will be displayed on the Site as follows:
- Product in stock,
- Product in stock with an external supplier,
- Product available to order, stating the time frame in which it can be delivered if an Order is placed;
- Product currently unavailable.
- Price of Goods and Services
All prices of the Goods and Services displayed on the Site are expressed in euro RON and include value added tax (VAT). The prices of the Goods do not include delivery.
Door-to-door delivery costs, as well as delivery, assembly and packaging collection costs, are communicated to the buyer when the order is placed.
The Seller may change at any time, without prior notice, the List Price and the Sale Price of any Product or Service displayed on the Site. When, as a result of technical malfunctions or human errors, the Sale Price displayed on the Site is not the real one, the provisions of art. 1665 of the Civil Code (Law no. 287/2009) regarding derisory prices may apply. In such cases there is no valid Contract concluded between the Seller and the Buyer, and the Goods and/or Services will not be delivered and/or provided.
- Payment and invoicing
The price, the payment method and, where applicable, the payment deadline are specified in each Order. The Buyer will pay for the order in lei (RON), at the National Bank of Romania (BNR) exchange rate valid on the day the Order is placed. The transactional message sent to the Buyer when an Order is placed on the Site will also include its total value in lei (RON).
The Seller will issue the Buyer an invoice for the Goods and Services delivered under the Order and will send it exclusively in electronic format, to the email address specified by the Buyer in the Order. The Buyer is obliged to provide all the information necessary for issuing the invoice, in accordance with the legislation in force.
The Seller will issue the invoice only after it has confirmation that the amounts owed by the Buyer have been received in its accounts. The transactional message that includes the invoice issued by the Seller constitutes confirmation of the Order placed by the Buyer.
The details of the cards with which Buyers pay for the Goods and/or Services will not be accessible to or stored by the Seller, but by the payment processor approved by the Seller and integrated into the Site, an entity authorised to provide such services and whose identity the Buyer will be informed of before entering the data required to process the payment.
- Delivery of Goods
Goods marked "product available in stock" on the Site will be delivered within 7 (seven) working days in Bucharest / Ilfov and within 14 (fourteen) working days in other localities. Goods marked "product available made to order" may be delivered, if an Order is placed, within the timeframes displayed on the Site.
Deadlines are counted starting from the day after the one on which the Buyer received the transactional Order confirmation message sent by the Seller.
The Seller will ensure proper packaging of the Goods and the transmission of the accompanying documents.
The Seller will deliver the Goods and Services only within the territory of Romania.
If the Seller cannot deliver a Good marked "product in stock" on the site within 14 (fourteen) business days, counted from the day after the Buyer received the transactional Order confirmation message, for reasons attributable exclusively to the Buyer, the Seller is entitled to charge the Buyer a daily storage fee of 0,5% (zero point five percent) calculated on the value of the Good.
- Transfer of ownership of the Goods
Ownership of the Goods will be transferred after the Buyer has made the payment, at the time the Goods are delivered to the location indicated in the Order. In this context, delivery means signing for receipt of the transport document of the Seller's delivery staff or of the courier, as applicable.
- Warranties on Goods
All Goods sold by the Seller benefit from warranty conditions in accordance with the legislation in force and the commercial policies of the manufacturers. The Goods are new, in their original packaging and come from sources authorised by each manufacturer.
The Goods will be accompanied by the documentation sent by the manufacturer and required by law for them, as applicable: certificate or declaration of conformity, warranty certificate, instructions for use, etc.

Casa Kendra uses certain data about the behaviour of Users, Account Holders and Buyers (for example, Goods viewed, added to the Wishlist or purchased in the past) to create profiles, for the purpose of personalising the Newsletters.
- Transactional and commercial messages
By creating an Account or placing an Order, the Account Holder or Buyer understands that they will receive transactional messages, including notifications about Goods added to the cart, Goods in Wishlists, Orders not yet completed, etc., by any means of communication available to the Seller, using the contact details provided by the Account Holder or Buyer.
In the case of Buyers, the Seller reserves the right to send them commercial messages by electronic means regarding products or services similar to those purchased, in accordance with the provisions of art. 12 para. 2 of Law no. 506/2004.
- Suggestions, notices and complaints
For suggestions, notices and complaints regarding the Goods and/or Services offered by the Seller, the User, Account Holder and Buyer can contact the specialised department Casa Kendra, la adresa de e-mail office@casakendra.ro sau la numărul de telefon +40 758 273 076 / +40 738 321 282 (program: Luni–Vineri 09:00–17:00 · Sâmbătă doar cu programare, cu 24 h înainte · Duminică închis, cu excepția zilelor de sărbătoare legală).
After exhausting internal conciliation avenues, and without prejudice in any way to the right of access to the courts, the Buyer (as a natural person) involved in a dispute with the Seller may turn to an out-of-court procedure for resolution. Such procedures are usually faster and cheaper than court proceedings, and more details about them are available at https://ec.europa.eu/consumers/odr/.
- Personal data processing

- Cookie policy

- Limitation of liability
The Seller cannot be held liable for damages of any kind that the Buyer or any third party may suffer as a result of the Seller's performance of any of its obligations under the Order, or for damages resulting from the use of the Goods and Services after delivery.
The Seller reserves the right to update and amend the terms and conditions periodically, in order to reflect changes in the way and conditions in which the Site operates or any changes in legal provisions. In the event of any such update, the amended version of the terms and conditions will always be displayed on the Site.
- Intellectual property rights
The Content, including but not limited to logos, stylised graphic representations, trademarks and commercial symbols, static images, dynamic images, text and/or multimedia content presented on the Site, is the exclusive property of the Seller, who reserves all rights obtained directly or indirectly (through publication and/or usage licences) over it.
The User, Account Holder or Buyer is not permitted to copy, distribute, publish, transfer to third parties, modify and/or alter, use, link to, display or include any Content in any context other than the original one, to include any Content outside the Site, to remove the marks signifying the Seller's copyright in the Content, or to take part in the transfer, sale or distribution of materials made by reproducing, modifying or displaying the Content, other than with the express written consent of the Seller.
The User, Account Holder or Buyer may copy, transfer and/or use Content only for personal or non-commercial purposes and only where this does not conflict with the provisions of these terms and conditions.
Any Content that the User, Account Holder or Buyer has or obtains access to by any means is subject to these terms and conditions, unless the Content is accompanied by a specific, valid usage agreement concluded between the Seller and the User, without any warranty from the Seller, implied or express, regarding that Content.
If the Seller grants the User, Account Holder or Buyer the right to use certain Content in a particular way, in the form described in a separate usage agreement, this right extends only to the Content defined in that agreement, only for the duration of the agreement and only in accordance with the conditions defined.
No Content transmitted to the User, Account Holder or Buyer, by any means of communication or obtained by them through accessing, visiting and/or viewing, constitutes a contractual obligation on the part of the Seller with respect to that content.
Any use of the Content for purposes other than those expressly permitted by these terms and conditions or by the user agreement, where one exists, is prohibited.
- Force majeure
Neither the Seller nor the Buyer shall be liable for failure to perform its contractual obligations if such failure to perform on time and/or properly, in whole or in part, is due to a force majeure event. Force majeure is an unforeseeable event, beyond the control of the parties, which cannot be avoided.
If, within 15 (fifteen) days from the date it occurred, that event does not cease, each party will have the right to notify the other party of the termination of the contract by operation of law, without either of them being able to claim further damages from the other.
- Applicable law and jurisdiction
This contract is governed by Romanian law. Any disputes arising between the Seller and Users, Account Holders and/or Buyers will be settled amicably or, if this is not possible, by the competent Romanian courts of Roman municipality.
